Definitions

Client: any professional, natural or legal persons within the meaning of articles 1123 and following of the Civil Code, who visit https://www.bissardon.fr (hereinafter referred to as the Site) that is covered by the present general terms and conditions.

 

Benefits and Services: SAS BISSARDON provides Clients with: Content: All constituent parts of the information on the Site, notably texts, images, and videos. Client information: (hereinafter referred to as “Information”) corresponding to all and any personal data that may be held by SAS BISSARDON for the purposes of managing your account, client relationship management and statistical analysis.

User: Person connecting to, navigating within or using the aforementioned Site. Personal data: “information permitting, in whatever form, directly or indirectly, the identification of physical persons concerned by such data.”  Article 4 of the French Act n° 78-17 of 6 January 1978). The meaning of the terms “personal data”, “persons concerned”, “subcontractor” and “sensitive data” are as defined by general Data Protection Legislation (RGPD n° 2016-679).

2. General Conditions governing Use of the Site and the Services Offered

The Site constitutes a work of authorship protected by intellectual property laws and applicable international regulations.

The Client may not, in any way, reuse, transfer or use for their own purposes, in whole or in part, the elements contained on the Site. The use of the Site https://www.bissardon.fr implies full and complete acceptance of the Terms and Conditions of use as described hereinafter. These terms of use are susceptible to modification or addition at any time, without prior notice, users of the site are therefore invited to check them regularly.

Users can normally access this website at all times. SAS BISSARDON may, however, decide to interrupt access to carry out technical maintenance. The website https://www.bissardon.fr is updated regularly by SAS BISSARDON. Similarly, legal information may be amended at any time; it is binding on the user, who is therefore advised to consult it as often as possible in order to be aware of any changes.

3. Description of Services Provided

The purpose of the Site is to provide information about all the company’s activities. SAS BISSARDON endeavours to ensure that all information on the site is as accurate as possible. However, it shall not be held responsible for omission, oversight, or inaccuracies that may occur when updating the site, whether these be of its own doing or of that of partner third parties who provide the information concerned. All content on the Site is provided for information purposes only and is subject to change. The information on https://www.bissardon.fr is not exhaustive and is subject to any amendments that may have been introduced since its publication.

4. Contractual Limits on Technical Data

The Site uses JavaScript technology. The website may not be held responsible for material damage connected to its use. Site users undertake to access the site using modern, virus-free equipment and an up-to-date browser of the latest generation. The site is hosted by a service provider in a member state of the European Union, in accordance with Data Protection legislation (RGPD n° 2016-679). The objective is to offer a service with the highest possible accessibility rate. The host provider ensures a continuity of service 24h/24h, 365 days of the year. It does, however, reserve the right to interrupt or suspend all or a portion of the site’s functionality at any time, for as little time as possible, in the case of maintenance, improvements to its infrastructure, system failure, or if traffic generated by the service is considered abnormal. SAS BISSARDON and the host provider shall not be held responsible in the event of a malfunction of the Internet, telephone lines, or receiving computer or telephone equipment related notably to congestion of the network preventing access to the server.

5. Intellectual Property

SAS BISSARDON is the owner of the intellectual property rights and retains all usage rights to the elements accessible on the Site, notably, text, images, graphics, logos, videos, icons and sounds.

All reproduction, representation, modification, publication, adaptation in whole or in part of all elements of the Site, by whatever means or format is forbidden without the express, prior, written consent of SAS BISSARDON.  Any unauthorised use of the site or of any of the items it contains shall be deemed to constitute an infringement and will be subject to legal proceedings in accordance with the provisions of articles L.335-2 and following of the French Intellectual Property Code.

6. Limitations of Liability.

SAS BISSARDON is the publisher of the Site. SAS BISSARDON is responsible for the quality and accuracy of the content that it publishes. SAS BISSARDON shall not be held responsible for any damage directly or indirectly caused to the user’s equipment when accessing the website https://www.bissardon.fr caused either by the use of equipment that does not conform to the specifications noted in paragraph 4, or by a bug or incompatibility. Nor shall SAS BISSARDON be held responsible for consequential damages (such as loss of market or missed opportunity) consecutive to the use of the Site.

Interactive areas (for asking questions in the Contact section) are available to users. SAS BISSARDON reserves the right to withdraw, without prior notice, any content in the area deemed inappropriate or in contravention of French legislation, in particular that relating to data protection. In such case, SAS BISSARDON also reserves the right to invoke the civil and/or penal responsibility of the user, in particular in case of content of a racist, offensive, defamatory or pornographic character, whatever the medium used (text, photograph etc.)

7. Management of personal data

The attention of the Client is drawn to legislation concerning communication marketing, the French Act for Confidence in the Digital Economy of 21 June 2004, the French Data Protection Act of 6 January 1978, as amended by the Act of 6 August 2004 and general Data Protection Legislation (RGPD n° 2016-679).

7.1 Collection of personal data

The processing of personal data collected, within the context of the creation of a User Account and subsequent browsing on the Site, is the responsibility of SAS BISSARDON. SAS BISSARDON is represented by Hervé Kratiroff, its legal representative. In processing the data it collects, SAS BISSARDON is committed to respecting the legal dispositions in force. It is incumbent upon them to set out the purposes of their data processing, to supply both clients and prospects with complete information concerning the processing of their personal data, and to maintain a correct register of all processing operations notified and permitted. Each time that SAS BISSARDON processes personal data, they take all reasonable steps to ensure the accuracy of records of personal information and their relevance to the purposes for which they are collected.

7.2 Use of Collected Data

SAS BISSARDON may process all or part of data collected to facilitate browsing and the management and traceability of goods and services ordered by the user, such as: connection and use of the site, billing and order history, etc. to combat computer fraud (spamming, hacking…) : type of hardware used, IP address, password (hashed) to improve navigation on the Site : connection and usage data to carry out voluntary satisfaction surveys on https://www.bissardon.fr : e-mail address and telephone number for commercial purposes (sms, mail). SAS BISSARDON does not sell or otherwise market any personal information to third parties but uses it only when necessary or for statistical purposes.

7.3 Rights of Access, Modification and Opposition

In accordance with the applicable European Regulations, users of https://www.bissardon.fr have the following rights: the right of access (article 15 RGPD), modification (article 16 RGPD), accuracy and completeness of user data, the right to obtain blocking or erasure of personal user data which is incomplete, inaccurate, ambiguous, expired or if its collection, utilisation, communication or conservation is prohibited, the right to freely withdraw consent at any time (article 13-2c RGPD), right to limit the processing of user data (article 18 RGPD), the right to oppose the usage of user data (article 21 RGPD), right to the portability of data that users have supplied when such data undergoes automatic processing operations based on their consent or contract (article 20 RGPD), the right to determine what happens to user data after the user’s death and to nominate (or not) a third party to whom they wish their user data to be transferred.  As soon as SAS BISSARDON becomes aware of the death of a user, and in the absence of instructions on their part, SAS BISSARDON undertakes to destroy their data, unless it is required as proof or to comply with legal or regulatory obligations. 7.4 Non-communication of personal data

SAS BISSARDON will not process, host or transfer user information collected to any country outside of the European Union or designated as having inadequate levels of protection by the European Commission, without prior notification to the Client. SAS BISSARDON nevertheless remains free to choose its technical and commercial subcontractors on condition that it offers sufficient safeguards with respect to the requirements of the general Data Protection legislation (RGPD n° 2016-679). SAS BISSARDON will exercise every care to protect the confidentiality of information, and most particularly ensure that it is not be communicated to non-authorised persons. However, if an incident which impacts on the integrity or confidentiality of the Client’s information is brought to the attention of SAS BISSARDON, they must inform the Client as rapidly as possible and indicate all corrective action taken. It should be noted that SAS BISSARDON collect no sensitive data. Personal user data may be processed by subsidiaries and service providers of SAS BISSARDON only to facilitate the aims set out above. Within the sphere of their respective responsibilities and for the purposes already mentioned, the people who may have access to user data collected on https://www.bissardon.fr are principally those working in our customer service department.

7.5 Types of data collected

We collect the following data from users of https://www.bissardon.fr, which is necessary for the successful functioning of the Site. This data is kept for a maximum period of 12 months after the end of the contractual relationship: Name, First Name, Profession, Company, Registration Number, e-mail, Address, Telephone No.  SAS BISSARDON also collects information that allows us to enhance user experience and offer customised content: Google Analytics. This data is kept for a maximum of 12 months after the end of the contractual relationship.

8. Incident Reporting

However much effort is employed, there is no method of transmission on internet and no means of electronic storage that is completely safe. It is therefore impossible to guarantee absolute security. If we become aware of a breach in security we alert the users concerned so that they may take the appropriate steps. Our incident reporting procedure takes full account of our legal obligations, whether they be at national or European level. We undertake to keep our clients fully informed of all questions relating to the security of their account and furnish all necessary information to enable them to meet their own legal obligations in terms of reporting.  No personal user data from the Site https://www.bissardon.fr is published without the accord of the user, or exchanged, transferred, given or sold by any medium whatsoever to third parties. Only the hypothesis of the sale of the company SAS BISSARDON and its rights would allow the transmission of the aforementioned information to a potential buyer who would in his turn be bound by the same obligation of conservation and modification of user data. 9. Hypertext links, cookies and internet tags

However, SAS BISSARDON is not able to check the content of the sites visited in this way, and consequently accepts no liability in this regard. 9.1. COOKIES

A cookie is a small file created in the browser of a user’s computer or smartphone by an Internet site. SAS BISSARDON may process information about a visitor’s use of the Site, such as the pages consulted, and searches undertaken. This information enables SAS BISSARDON to improve the Site content, and the user’s browsing experience. Article 9.2. INTERNET TAGS

SAS BISSARDON may occasionally use internet tags (also known as action tags, single pixel GIFs, transparent GIFs, invisible GIFs or one by one GIFs) activated via a partner specialising in Web analysis who may be based (and therefore store corresponding information, including the user’s IP address) in another country. These tags appear both in online advertising that enables internet users to access the Site, and on different pages of the Site. 10. APPLICABLE LAW AND ATTRIBUTION OF JURISDICTION

Any dispute related to use of the website https://www.bissardon.fr is governed by French Law and shall be referred exclusively to the jurisdiction of the competent court in Lyon, except in cases expressly provided for by law.
